Legionella Risk Assessment - Information

Under general Health and Safety law, as an employer or person in control of a premises (eg a Landlord), you have Health and Safety duties and need to take suitable precautions to prevent or control the risk of exposure to Legionella.
Landlords who provide residential accommodation (as the person responsible for the water system in their premises) have a legal duty to ensure the risk of exposure of tenants to Legionella is properly assessed and controlled.

What do I have to do?

  • Landlords and Managing agents should arrange for a competent person to conduct a Risk Assessment of the water system of the properties they are responsible for and document it along with a Legionella management strategy. 
  • Take action to ensure that any risks of potential exposure are properly controlled and keep appropriate records. 
  • Inform tenants of the potential risk of exposure to Legionella. 

An SRS properly documented Legionella Risk Assessment supplied to the Tenant at your property fulfils the Health and Safety obligations.  Risks are clearly identified and documented advice and guidance provided to the Tenant(s)

The law applies to you if you are:

  • The Duty Holder (Landlord)
  • The Responsible Person (Managing Agent – acting on behalf of a Landlord)
